Glowstreet terms of use
1. About these terms
Glowstreet is run by POWR DATA Pty Ltd (ACN 692 119 476, ABN 37 692 119 476), based in Brisbane, Queensland, Australia. In these terms "POWR DATA", "we", "our" and "us" mean POWR DATA Pty Ltd.
These terms cover the Glowstreet app, glowstreet.app and the related services we run (together, "Glowstreet"). That includes the Glowstreet AI connector in section 14.
By signing up, you agree to these terms and you confirm you are 16 or over. If you only browse the map, these terms still apply to how you use Glowstreet. If you do not agree, please do not use Glowstreet.
Read these terms together with the Glowstreet Privacy Policy at glowstreet.app/privacy.
2. What Glowstreet is, and what it is not
Glowstreet is a free community map of homes and streets decorated for Halloween and Christmas. People add the glows they know about. Other people confirm them, rate them and flag them when they are gone.
Glowstreet is a guide only. It is not a promise that a glow is open, safe, still there or welcoming visitors on a given night.
A pin is not an invitation from the people who live there. It does not mean the residents agreed to be listed or to have visitors.
We do not run, own, check or supervise any glow or home shown on the map.
3. Where you can use Glowstreet
You can view Glowstreet from anywhere.
You can add glow spots only in the countries the app supports. Right now that is Australia and New Zealand. We will update the app and these terms when we add more countries.
Halloween and Christmas fall at different times of year, and in different weather, depending on where you are. Season dates are shown in the app.
4. Who can use Glowstreet
Anyone can view the map without an account.
You must be 16 or over to create an account, or older if the law where you live requires it. You need an account to add, verify, rate or report a glow spot.
Children under 16 are welcome to look at the map with a parent or carer. A parent or carer should be with younger children when they go out to see glows, and is responsible for their safety.
5. Your account
You need an email address, a username, a password and an icon style to create an account. You can also save a home area, which is a suburb or postcode.
Give us accurate details. Keep your password safe. You are responsible for what happens in your account. Tell us at hello@glowstreet.app if you think someone else has used it.
You must confirm your email address before you add, verify, rate or report.
One account per person. Do not create extra accounts to verify your own pins, push up ratings or get around a suspension.
6. What you can type into Glowstreet
Glowstreet has no comments, messages, photos or public profiles. The only things you can type are:
- your username, which other people do not see on pins (we may show it when we feature a glow spot you added; see section 7)
- an address search, which must end with an address picked from the list
- an optional note when you report a pin or a problem, which only POWR DATA reads
Keep other people's names, contact details and other personal information out of all three. Do not use a username that includes your full name, a child's name, an address or anything offensive.
7. Adding a glow spot
Only add a home or street that is clearly decorated so people can enjoy it from the street.
When you add a glow spot:
- the glow must be visible from a public footpath or road
- pick the address from the list so the pin lands in the right place
- add it only if you have seen it, or you have good reason to believe it is running this season
- you may add a glow spot at a home that is not yours, as long as it is a genuine public glow
Do not add:
- a home that is not decorated for visitors
- an address we have blocked (section 17)
- fake pins, joke pins or pins meant to send people to the wrong place
If you remove a pin you added, you or anyone else can add that address again later.
What other people can see
A new pin starts as unverified. Unverified pins show the street and suburb only, and the map point is moved by up to about 100 metres so it does not mark the exact home.
A pin becomes verified when other people confirm it is real. Verified pins show the full street address so visitors can find the glow.
Your username is not shown on a pin. We keep a private record of who added it so we can deal with reports. We may show your username and the glow spot's suburb, but never the street or address, when we feature a glow spot you added on glowstreet.app or our social channels. See the Privacy Policy, section 6.
Pins from public sources
Some unverified pins come from public sources such as news stories, public groups and community lists. We add these as unverified until local people confirm them. They follow the same rules as any other pin.
Pins from last year
Pins can carry over from one year to the next as unverified. They act as a guide to popular areas until the community verifies them again or flags them "Not there".
Example pins
Some pins are labelled Example. They sit in public parks to show how the map works. They are not homes and cannot be verified, rated or reported.
8. Verifying, rating and flagging
Verify, rate or flag a glow spot only when you have seen it yourself or you know first hand.
You cannot verify a pin you added.
How a rating confirms a glow spot, how the tiers work, and the daily limits are on the How it works page.
Use "Not there" when the glow has gone, is not decorated or is in the wrong place. Enough "Not there" flags remove a pin from the map. The address can be added again later.
Do not coordinate with others to push a glow spot up or down, or to remove a genuine glow.
9. Conduct standards
You must not use Glowstreet to:
- harass, threaten, shame or target a household or any other person
- post anything offensive, hateful or discriminatory, including on the basis of race, religion, culture, sexuality, gender identity, age or disability
- share someone's personal information without their permission
- impersonate another person, including pretending to live at a home to have it removed
- encourage anyone to trespass, damage property or break the law
- break the law
You must not scrape, copy in bulk, resell or republish the map data without our written permission. You must not interfere with Glowstreet, its security or its limits, or try to access another person's account.
We have no tolerance for objectionable content or abusive users. We remove content that breaks these terms. We may suspend or close the account of anyone who posts it or who abuses other people.
10. If it's your home
You can ask us to take your home off Glowstreet. To protect residents and contributors, we review each request before we remove a pin.
How to ask
- In the app, open the pin, tap Report and choose "This is my home, please don't share it".
- Or email hello@glowstreet.app with the address and the words "This is my home". You do not need an account.
What happens next
While we review it, we may hide the street number and show the street only, or hide the pin.
We ask you for reasonable proof that you live at the property or are responsible for it, such as the owner, tenant or property manager. You choose one of:
- a recent bill, rates notice, lease, insurance notice or official letter showing the address, with your name, account numbers and other details blacked out
- a photo of the front of the property taken from the street, showing a handwritten note with the reference code we email you, and no people or number plates
- another reasonable option we agree with you
Do not send passports, driver licences or other identity documents. We do not need them.
We aim to acknowledge and decide within 7 days of receiving proof.
Safety first
If being on the map puts you or someone in your home at risk, tell us. We hide the pin as soon as we see your request and do not ask for proof. When we confirm it, we remove the pin and block the address.
The outcome
- If we confirm the request, we remove the pin and block the address. It cannot be added again, in any season, while the block is in place. We can lift the block if we change our decision, for example after a review.
- If we cannot confirm it, we tell you why. The pin may go back to normal, or we may keep it at street level only.
- If we do not hear back within 14 days of asking for proof, we close the request. You can start again at any time.
We delete the proof you send within 7 days of our decision. We keep only a note of the type of proof, the date and the outcome.
Not happy with the decision
Reply to our decision email within 30 days and tell us why. Someone at POWR DATA will look at it again, and we reply within 10 business days. We may keep our decision or change it, and we tell you why. If we overturn a confirmed removal, we lift the block and the pin can go back on the map. You can also complain to a privacy regulator, as set out in the Privacy Policy.
If something is wrong but you are happy to be on the map
Use Report, or email us, and we will fix it.
11. Reports and moderation
Anyone with an account can report a pin. Reasons include offensive, fake, privacy, and "This is my home, please don't share it". You can add a note.
POWR DATA reads every report. A report does not remove a pin by itself. A "This is my home, please don't share it" report starts a removal request (section 10). We aim to review reports within 24 hours, and sooner during the main season.
When we review a report, we keep the pin, hide it or remove it. We can put a hidden pin back. Removing a pin after a report does not block the address. Only a confirmed removal request does that (section 10).
We may, acting reasonably:
- hide a pin while we review it
- move a pin from full address to street level
- edit or remove a pin
- refuse or block a location
- limit, suspend or close an account that breaks these terms, misuses Glowstreet or puts other people at risk
If you think we got a moderation decision wrong, email hello@glowstreet.app and we will take another look.
There is no block button. Glowstreet does not show who added a pin, so there is no one to block. Report the pin instead.
12. Visiting glows
Glowstreet helps you find glows. How you visit them is up to you, and you visit at your own risk.
When you visit:
- stay on public footpaths and roads
- do not enter a front yard, driveway or garden unless the residents clearly invite visitors in
- follow signs and posted viewing hours, and move on when lights are off
- keep noise down, do not block driveways, and park legally and safely
- respect residents and their neighbours
- take care crossing roads and watch for traffic in the dark
- supervise children at all times
- only accept treats that are sealed and wrapped
Do not use Glowstreet while you are driving. Plan before you leave, or ask a passenger to use the app.
Displays can include lights, cables, inflatables, props and other hazards. Residents are responsible for their own displays. We do not inspect displays and cannot tell you whether a display or the area around it is safe.
13. Information on the map may be wrong
Glowstreet runs on information from the community, and some of it will be out of date or wrong. A glow may have moved, finished or never existed. An address may be off by a property or two.
Errors like these are part of any community map. Check before you travel and use your own judgement when you arrive.
Address and map information comes from public sources: Geoscape G-NAF and LINZ for addresses, and OpenStreetMap (through Photon and OpenFreeMap) for search and maps. We do not control these sources and they can be out of date or wrong. Credits are in section 25.
14. The Glowstreet AI connector
We offer a public, read-only connector so AI assistants, such as ChatGPT and Claude, can look up Glowstreet pins and hot streets.
The connector shows the same public information as the map. Unverified pins are shown at street level only. The connector cannot add, change or remove anything, and it does not share account details.
Answers from an AI assistant are written by that assistant, not by us, and can be wrong. Check the map before you travel. Your use of an AI assistant is covered by that provider's own terms.
Approximate spots and private homes
Glow spot locations shown through AI assistants, and on maps people share, are approximate. A spot may be a private residence. View it from the street, respect privacy, and do not trespass.
15. Your content and our rights
Pins, ratings, verifications, flags and reports you add are your content.
You give us a non-exclusive, royalty-free, worldwide licence to host, store, display, adapt and share your content to run, improve and promote Glowstreet. This includes the map, the AI connector, hot streets and pins carried over to later years. The licence continues for pins that stay on the map after you delete your account, as explained in section 20.
You promise that what you add is honest and does not break the law or anyone's rights.
If you send us feedback or ideas, we may use them without owing you anything.
Glowstreet, including its software, design, icon art, name and logo, belongs to POWR DATA or its licensors. You may use Glowstreet for personal, non-commercial purposes under these terms. Map data is © OpenStreetMap contributors under the Open Database Licence. Address data is credited in section 25.
16. Cost
Glowstreet is free. There are no paid plans or in-app purchases.
17. Removed pins and blocked addresses
A pin can leave the map in two ways.
Removed. You remove a pin you added. Enough "Not there" flags remove it. We remove it after a report. Or the person who added it deletes their account. The pin leaves the map. The address can be added again later.
Blocked. We confirm a safety request or a request from a resident. We remove the pin and block the address. It cannot be added again, in any season, while the block is in place. We can lift the block if we change our decision, for example after a review.
18. News emails
When you sign up, a separate box lets you choose to get news about Glowstreet and other POWR DATA products. It starts unticked. Agreeing to these terms does not sign you up.
You can turn news off at any time in Profile or with the unsubscribe link in any news email. We still send emails you need for your account, such as email confirmation and password resets.
19. Seasons, availability and changes
Glowstreet is seasonal. We may limit adding, verifying and rating outside the Halloween and Christmas seasons. Between seasons we may archive pins or carry them over as unverified (section 7).
We try to keep Glowstreet working, but we do not promise it will always be available, error free or uninterrupted, especially on busy nights.
We may change, pause or stop features, or Glowstreet itself. Where a change is significant, we will give notice in the app or by email where practicable.
20. Ending these terms
You can stop using Glowstreet and delete your account at any time in Profile or at glowstreet.app/delete-account.
When you delete your account, we delete your personal details. Pins you added that have not leveled up are removed from the map. Pins that have leveled up stay on the map without your name. We also delete your ratings, verifications and reports. Our internal records of changes to pins and ratings keep a random number that does not identify you.
We may suspend or close your account if you seriously or repeatedly break these terms, if the law requires it, or if we stop running Glowstreet. We will act reasonably and give notice where practicable.
Sections 15, 21, 22 and 23 continue after these terms end.
21. Your consumer rights
Nothing in these terms excludes, restricts or changes any right or remedy you have under the consumer or privacy laws of the place where you live that cannot lawfully be excluded. That includes the Australian Consumer Law, the New Zealand Consumer Guarantees Act 1993 and Fair Trading Act 1986, and consumer laws in the United Kingdom, the European Union and elsewhere.
Where the law lets us limit our liability for a failure to meet a consumer guarantee, our liability is limited, at our choice, to supplying the service again or paying the cost of having it supplied again.
22. Liability
Subject to section 21, and to the extent permitted by law:
- we are not responsible for what happens when you visit a glow, including injury, loss or damage caused by a glow, a property, a resident, traffic or another visitor
- we are not responsible for content added by other people, or for decisions you make based on it
- we are not liable for indirect or consequential loss
- our total liability arising from or in connection with Glowstreet is limited to the greater of (a) the fees you have paid us in the 12 months before the claim and (b) AUD $100. Glowstreet is free, so for nearly everyone this means AUD $100
- you indemnify us against loss, damage and costs we reasonably incur because you broke these terms or used Glowstreet unlawfully, except to the extent we caused the loss
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.
23. Governing law
These terms are governed by the laws of Queensland, Australia. The courts of Queensland and the federal courts of Australia can hear disputes.
If you live outside Australia, you keep the protection of the laws of the place where you live that cannot be excluded by agreement. Where those laws allow it, you can also bring a claim in the courts where you live.
24. Changes to these terms
We may update these terms. The current version is always at glowstreet.app/terms, with its effective date at the top.
If we make a significant change, we will tell you in the app or by email before it takes effect, and we may ask you to accept the new version before you add, verify, rate or report again.
